Can Adults Receive Benefits Meant for Children?

by | Dec 8, 2015 | Lawyers

Recent adults (18-22) who received benefits as child often rely on the benefits they receive to stay stable in life, and to unlock potential opportunities. After turning 18, some of these children may still remain in dire need of these important benefits, even though they are now technically adults. For those individuals dealing with disability benefits in Baltimore, it is essential that they discover whether or not they may still be able to receive the benefits they have become accustomed to as disabled person.

Firstly, you will have to determine whether or not you qualify as what is known as a “disabled adult child.” To qualify in the eyes of the SSA, you must meet the following four requirements:

*  You must be over the age of 18.
*  Your disability began before the age of 22.
*  You are not currently married.
Your parent must currently be receiving social security disability benefits, or did at one point before their death.

If you are found to qualify as a disabled adult child, you can begin receiving monthly payments through the SSDI (Social Security Disability Insurance) program. However, you are still considered an adult “child” since your qualification will be based off your parents pre-existing qualification for SSDI benefits.

For the disability you have experienced before the age of 22, you will need to meet the current qualifications:

*  The disability you have has been existed for at least 12 months, or expected to experience the effects of the disability for at least 12 months.
*  The disability, or the treatment of your disability, must keep you from being able to perform substantial work.
*  Your disability must fall under the listed impairment list improved by the SSA.
*  OR your disability must “equal” the effects of an existing listed impairment.

In the case that you end up marrying after beginning to receive SSDI benefits as an adult child, you will stop being able to receive these important benefits. For this reason, you may need to postpone any marriage plans until after you no longer qualify for, or need these SSDI payments.
